Day 27: A fishy meeting in the Red Lobster bathroom

He is currently in custody with the County of Santa Clara. He was convicted of taking a car, and possessing ammo in 2008. He grew up with Campbell. David was robbed outside of a Red Lobster during an evening while Campbell was a fugitive. A mini-van was used that had two African-American males, one African-American female, and Rodney McNeary. David identified the female as Janielle Carter. Janielle and McNeary had come over David's house a week before trying to sell him "jewelry". The mini-van was full of boxes. David didn't know the other 2 African-American males. McNeary was known as "sic-loc". When McNeary was talking to David, he was sweaty and antsy. McNeary also told David that "Campbell didn't do it". At that point McNeary robbed David. He pulled out a .357, and took a couple hundred dollars, a gold necklace, a bracelet, and David's driver license. The two other males then jumped out and made David take off his red shoes, and red shirt. David called the cops and reported the robbery. He told the police that he didn't know who robbed him (he lied). He just gave the police a description of the individual. He felt like he was in danger of his life and his parents because he lived with his parents. LANE: David has been truthful as much as he remembers. He doesn't remember if he had scheduled a meeting with McNeary at the Red Lobster. In 2001 he sold weed, and set up a meeting to sell to McNeary. In an interview in 2006 with Det. Ramirez, David said he set up the meeting with McNeary. The "meeting" started in the parking lot, they went into the Red Lobster, then ended in the parking lot. The drug deal went bad . He was trying to sell about $300 worth of weed. The drug deal took place in the Red Lobster bathroom. David started the confrontation because he thought he got shorted by McNeary, so he ran outside and stopped the mini-van as it was leavivng. McNeary had the gun in his right hand and put it in David's ribs. He told the police the suspect had his hands in pants like he had a gun. Nothing in police report about a gun being pulled. He didn't tell the police about the drug deal either, he didn't want to "incriminate" himself. The only reason David called the police was because McNeary took his drivers license. If McNeary didn't take his license David would have "chalked it up as a loss". With the drivers license McNeary knew where David lived. What about when McNeary and Janielle went to his house to sell jewelry? He didn't think he would be able to find the house again on his own. Also, they met on the side of the house, not in the house. He only told the police that McNeary took his shoes. He can't recall why he didn't tell the police about McNeary taking his shirt also. David told the police that McNeary stole $97. David use to "run" with Robert Jr. and Edwin Campbell. David only called the police because he got robbed, not because he was told "Campbell didn't do it". David did talk to Robert Campbell Sr. about what McNeary told him. McNeary told David about the shooting before the drug deal went south. David was interviewed by David Lucio in 2003, and by Sally Graver in 2006. David is telling different stories. He must be having memory problems. He remembers bits and pieces, which are all true, they are just bits and pieces. There are 4 different accounts. The felonies he was convicted of were :
-felony car theft
-felon in possession of ammunition.
As far as David remembers McNeary was driving the van first, and then Janielle drove them away. The two males in the van also had guns. He told police he never saw a gun. He told Lucio he never saw a gun. He can't remember what he told Sally. DEFENSE: The incident occurred on Nov. 4th. McNeary was wearing a dark beanie. David told the police that it was a dark Dodge mini-van. He described the suspect as 6'3 200+lbs. (McNeary). He told the police that they made him undress and his shoes were scattered in the parking lot. David was concerned that McNeary had his drivers license. He was out of his house when McNeary and Janielle showed up to sell jewelry. When he was robbed the van was between the front door of the Red Lobster and himself. David saw luggage in the van and knew McNeary was leaving town. McNeary was wearing dark brown or black clothes that night. David hasn't been threatened in this case. David isn't afraid of "sic-loc" because he got a gun. LANE: He told investigators that he got a bulletproof vest not a gun. DEFENSE: David needed a vest for his safety. JUROR: How did Campbell come up in conversation? McNeary brought it up. How long did the conversation last? about 45 secs. LANE:David is 33 years old and doesn't know about daylight savings. David told police the robbery occurred around 9pm.

There is no court Tuesday.
We are back Wednesday....... Campbell could be Wednesday or Thursday

  1. Greg, the only way that jury can possibly remember why they are there is because you and your mom are visible.

    How many days has it been since Jeff's name has been mentioned?

    The defense is throwing lots of crap at the jury in the hopes they will get in the jury room and ask "what's this case about?" I ask that when I read your summaries. For the life of me I can't understand what a bunch of lying gangsta thugs has to do with that murder.

  2. Fortunately, the "some other dude did it" seldom works. The true retard in the courtroom is Ed Souza.
    Keep the faith, the system will work.
    Lane should remind the jury why they are there and how simply desperate the defense is. The jury should be angry that the defense has wasted so much of their life.

  3. What I don't understand is why you don't seem this is usefull testimony. Rodney seems like a criminal to me. His own girlfriend confirmas that, plus his criminal record. Why couldn't he shoot an officer. It seems like the investigators should've done a better job questioning witnesses.
