This takes place from the short amount of court yesterday and all of today. You can now follow the contradictions.....
Lacey Drake
DEFENSE:She knows Campbell through her ex-husband Roger, and Janielle Carter. She heard the phone ring about 4am, Roger answered it and took the call. He didn't tell her, but she overheard some of the conversation. She heard "9-1-1 187(that means murdered) shot". She is afraid of McNeary and didn't remember being interviewed by police on 3/18/02. She would move quickly after the shooting because she feared for her life. McNeary talked to Roger. Within 3 days of the shooting McNeary stopped by her house to talk to Roger. She didn't hear anything, she wasn't in the room, and never saw McNeary when he was there. McNeary came by the house around 6-7am. They talked for 15 minutes and then left. While McNeary was there, Roger told Lacey to pull some thorns out of McNeary's butt. Roger posted bail for Janielle Carter when she was arrested. Roger told McNeary that he couldn't "hide out" at his house. TODAY DEFENSE: She heard "9-1-1 187 I didn't mean to do it". McNeary asked to hide at their house, Roger said no. McNeary told her not to use phones because the police took caller ID's and phones. Lacey was told not to call Janielle because her phone had been taken by police. McNeary use to sell weed to Roger. LANE: Her illness makes her memory bad. She was on Diloted (pain killer) when she talked to Sally Graver. She thinks McNeary will harm her if she talked, because McNeary can "reach out and touch someone". Before talking to the police, she had quit her job and moved. She knows that McNeary did it. McNeary called that morning and then showed up at the house that morning saying "9-1-1 187, I didn't mean to do it". Police never asked her the question if McNeary did it. She doesn't gossip about this case. Did McNeary say anything more then "9-1-1 187, I didn't mean to do it" NO. She didn't follow the media, didn't speak husband, she did talk to her sister though. She told her sister about what McNeary said, she also told it to the officer she was interviewed by. She never talked to Janielle about this statement, and never talked to McNeary about the crime. She called Janielle once or twice. After that morning, she didn't call Janielle to see what was going on. Lacey picked the thorns out of McNeary's butt because Roger told her to. Lacey also heard that Janielle took thorns out of his butt. Lacey's sister is the source of information in his case, but she won't change what she has seen or heard. There is a lot of talk around San Jose streets about this case, you just have to listen. DEFENSE: Off'ing = taking her last breath. The call from McNeary came in around 2-3am or possibly 4-5am. McNeary came by a few days later. Lacey remembers now that the interview with police lasted for about 30 minutes. The officer was writing down what she said. She only told "9-1-1 187" to Roger, her sister and Sally. She only feared McNeary not any other members, but members that were loyal to McNeary. LANE: She doesn't know who was loyal to McNeary in 2009. She cut ties and left in 2004. Lacey's information about the gang is 5 years old. She doesn't like McNeary, and tried not to listen to him. DEFENSE: OG= original gangster.
This motion was now argued and only certain parts were allowed in. You will notice what was allowed as your continue to read, and you will see some changes in her testimony....The prosecution rested their case on provision. This is the first witness for the defense::
Lacey Drake: She has know Campbell for about 15 years from the neighborhood. She was married to Roger in 2001 and knew McNeary through Janielle and Roger. She also knows Janielle from the neighborhood. She got a phone call between 2-3am, it could have been later but it was before 8am. Roger was in the next room, answered the call and talk to McNeary. McNeary came by the house, she was watching TV with Roger, she left to the bedroom. McNeary said " 9-1-1 got shot, 187, I didn't mean to do it". He sounded scared, and cold. He asked to stay at the house and Roger said no. She pulled thorns out of McNeary's butt. McNeary scares her and could kill her, she moved because McNeary could "blow my house up". LANE: McNeary didn't confess to the murder, she took it that he killed the officer. McNeary confessed within a matter of days and Campbell was arrested, but she didn't call the police. The officer's family has a right to know who killed him. She did call the police and they told her "they were too busy"(if you tell police you have information about a cop killer, i don't think that would be their response). She never gossiped about the case, she didn't try to play detective and solve the case. Lacey knew the mustang was at the scene, Hyundai was there too because it was public record. The officer that interviewed her never asked if McNeary shot the officer. She thinks the officer she talked to was with Milpitas police department. Lacey couldn't live with herself and not tell someone the truth. She didn't tell the officer that she was eavesdropping on McNeary's conversation. She did lie in yesterday's testimony a few times. The last time she saw McNeary was 7 years ago. The officer DID ask her if McNeary confessed and she said no he didn't, she thinks she said that because she was scared. Lacey has gotten information from the streets, her sister and her husband. She said yesterday she didn't have a face-face conversation with McNeary. She was spreading gossip to the officer about where McNeary was that night, and that he got into a car chase. She said she couldn't believe McNeary would run from some football players, and that he would only run if he was running from the police. She was pointing the cops toward McNeary even though she was scared of him. McNeary didn't blatantly confess to her. Lacey said "not everyday does someone kill someone" (she doesn't watch/read the news). Lacey said "we don't believe Campbell did it", no question that McNeary did it, "I just can't fricken believe it". She is mad she has to hide with her family. She wanted McNeary because he owed her and Roger $50K for the bail they posted for Janielle. She wasn't pissed over the money, she was mad that Campbell was charged with a crime he didn't commit. She told the police that it was a face-face conversation with McNeary, she didn't lie because he was in the house. She called McNeary/Janielle 3 times the morning of the shootings, she didn't lie about that either. She knew Janielle got arrested because McNeary must have told her. Her memory is real bad. She thinks Roger must have told her that McNeary was interviewed by the police. She doesn't know how she knew what was taken from Janielle's apartment. She never called Janielle but she was told about her caller ID being taken. McNeary must have told her that he ran all the way to Gilroy. She lied yesterday because it has been so long, and she is so scared. Lacey doesn't know how McNeary got to her house. She worked M-F at the time of the shooting. When she talked to Sally Graver she was on Diloted.
That's it for today. She isn't done but she won't be back until the 13th. Tomorrow will be new witnesses.

Oh sweet mother of God, her “illness” makes her forget and she was on dilaudid?
ReplyDeleteIs there anyone in this circle of, ahem, friends who wasn’t/isn’t on drugs, prescription or otherwise? And wherein God’s name do people go to get this stuff? Dilaudid is for cancer and intractable pain!
I’m no expert in gangsta-ness, but isn’t an “OG” someone like Tookie Smith and that ilk?
I pray that jury was sitting there thinking WTF in their heads as this crap was being spewed.
Isn't this the bottom line: there is evidence a blind man can see putting Campbell at the scene, and more than one bit of evidence too, at the scene and during the time Mr. Newly-Mentally Retarded was on the run; but there is none, zero, zilch for McNary.
Not to mention a defense attorney who fought to have his client declared mentally retarded? I mean come on, if he didn't do it, don't most people not want to be mentally retarded? That says lots to me too!
Expect a very long deliberation, just so the jury can check off all of the inconsistencies and do their best to ensure no mistrial.
