Day 26: Locomotion

Sgt. Edwards - SJPD
He interviewed Janielle Carter on 10/28/01. He also had interviews in December 2001 & in 2003. He can't recall if Sgt. Panti and Ofc. Johnson had left when he entered the interview room. During his first interview with Janielle, she continued to lie about what happened with her car. After awhile with Janielle the Sgt. put Janielle in the same room with McNeary. At this point Sgt. Edwards had already been in the interview with McNeary prior to talking to Janielle. Sgt. Edwards interviewed Janielle later that night also. In the later interview she gave more facts about what happened with her car, and the calls from people that morning. <> Sgt. Edwards doesn't know exactly when Janielle started to tell the truth. In the '03 interview with Janielle she doesn't say where McNeary was going, but that he left with 3 other guys (Turo, Deon, Campbell). In 12/01 interview Janielle said Tyree first called around 4:10am and said "9-1-1 got popped". During a 10/30/01 interview with Sebastian Cadena, Sgt. Edwards was looking for statements from when Campbell stopped by his house. Cadena made statements implicating Campbell in the shooting. Campbell had asked Cadena for a place to stay, but was rebuffed. Before asking about a place to stay, nothing was said about the involvement. LANE: Sgt. Edwards didn't ask any questions about Janielle's trash.

Ofc. Lagergeren - SJPD
He was the CSI on the black mustang. He investigated the mustang at the vehicle warehouse. The damage to the car was noted as:
-scrapes just behind the passenger side door.
-passenger side-view mirror was dangling down
-scuffs on the front bumper
-driver side window post had scuffs
-small marks on front windshield
He didn't write a report, the notes he takes along with phones act as his report. He found two lighters on the drivers seat. He found a cigarette butt on the center console. A cigar box on the passenger seat had a partial smoked "cigar". He also found two sets of gloves. There was no damage to the ignition. LANE: The damage appeared fresh. Driver side window wasn't smashed, all windows were intact. DEFENSE: You can't tell by the photos but there is some damage to the front windshield. The date of the examination was 10/29/01. LANE: Shows photos of car. DEFENSE: The damage could be minor to the front windshield since it was noted. JUROR: Could be a crack in the lower right window in the pictures? Yes it could be a crack.

Kenneth Riggins - McNeary friend
He knew McNeary because he use to live under McNeary and Janielle on Turner Way. He can't remember who called him on the morning of 10/28/01. They wanted to go looking for her car, it was in the morning time. He talked to the SJPD twice, once at his apt. and once at the police department. Kenneth picked up McNeary and Janielle and drove them to where the car was. They couldn't get to the car because of the police. When they called it was like "can you do me a favor type of call". Kenneth picked them up in his Pontiac Firebird. They told them to drive to Almaden Valley. They were looking for a mustang. Kenneth had know them for a few months, they lived together and they both drove the mustang. He think Janielle had said they were at a party the night before and had to leave the car. Janielle didn't say the car was stolen. He doesn't know who went to the party. They were both directing him, neither asked to stop the car. They then drove back to Janielle's apt. McNeary stayed with Kenneth. Kenneth then dropped McNeary off at a friends house, and headed to K-mart. When he got home the police were at his apartment along with McNeary. LANE: It is fair to say he didn't know who went to the party. Told Sally Graver that McNeary was giving him the directions. He remembers that McNeary did stop and get out of the car. It was a residential neighborhood where they stopped. On 10/28/01 he had separated from his wife and had moved to Gettysburg Rd. DEFENSE: Kenneth remembers McNeary getting his keys out of a field. At that time a lot of streets were blocked by police. JUROR: Did McNeary or Janielle seem nervous? No, they seemed concerned.
Was their demeanor odd that day? No. Were they more quiet then usual? No.


That's it for this week. Next week there is no court on Tuesday. Campbell could be on the stand on Wednesday ( I will let you know)
