Day 39:"In Valor there is hope"...... case to the Jury! :

Lane continued:
Robert Campbell Sr. talked to Janee 1-2 weeks after the shooting. Janee told Robert Sr. that "McNeary had a girlfriend, that Janielle didn't know about, and McNeary wanted her to keep mouth shut, Janee was suspicious of him threatening her in that manner". The defense wants you to think that Janee wouldn't lie because she was scared of McNeary. Ruben Martinez heard Robert Sr. yelling at DeShawn about having his gun. Why did Robert Sr. leave Sacramento so early that morning. There was something very important to bring him back to San Jose. Why did Robert Sr. call Edwin at 2:26am? There had to be a call from DeShawn to Robert Sr. after the party, that he was pumped up and heading back with a gun. These are the family secrets. This is between the father and the sons, we couldn't get these secrets from them. The defense said there were two runners from the crime scene, but why did all 3 testify to only one set of footprints. The defense is ignoring what they are saying. Why was McNeary standing at that street corner 2 hours after parking the mustang. Why didn't McNeary just go and drive the mustang away? Why did Campbell drive to the end of the street to pick up McNeary? It doesn't make sense. How did McNeary know Campbell had a gun? According to Campbell McNeary saw the gun on the floor. In closing arguments, the defense said Campbell told McNeary had a gun. Why were Ofc. Fontana's lights in the number 2 position? Because it was a car stop. Why did McNeary give the gun back to Campbell? When you murder someone and someone else sees it you won't give the gun to them because you won't know if they will turn it on you. You get rid of the gun yourself, you don't trust anyone else to do it. Campbell always runs, but why didn't McNeary get into the car and drive away? Why did McNeary return to the scene twice? That is totally inconsistent with someone who murders a cop. The car is there, but it would be worse for him to be there and trying to move the car. Why did Campbell tell his father that he "didn't realize he had it until he shot the officer". Why didn't the defense to bring in Kenny? If Janee is telling the truth why wouldn't she allow the police to interview her? Why did Lacey tell Ofc. Thomas that McNeary didn't confess to her or her husband? The defense said Campbell has spacial relation problems because he puts Jeff's body in the wrong place, but when you draws his getaway route he is totally correct and we are suppose to believe him. Lacey has a lot of problems with her testimony.
  • In her first interview with police she tells them that McNeary never confessed
  • claimed that she called 311 to tell another officer, that's a lie
  • claimed she moved 1 week after confession because she was afraid of McNeary, that's a lie
  • insisted that McNeary never confessed to her
  • she only traded gossip with her husband and sister. She was overly involved in this case
The defense can't explain any of these problems because Lacey never heard a confession. David Jackson also had some problems:
  • during robbery McNeary tells him that Campbell didn't do it.
  • never told this "confession" to police while they interviewed him about the robbery
  • lied to the jury about the robbery. It was a drug deal gone bad.
  • Jackson and McNeary don't know each other so why would McNeary tell him about Campbell not being the shooter?
Janee
  • Frequently changes her story
  • demeanor on the witness stand was poor
  • uncooperative and threatened to walk out of the court
  • hostile towards the prosecution
  • her time line of the incident doesn't make sense
  • claims McNeary confessed 2-4 days after meeting her
  • refused to be interviewed by police
  • the defense never corroborated her story.
These witnesses are diminished goods. You can't create reasonable doubt with witnesses you don't believe. The first interviews these witnesses gave is a different story then they tell you today. Janee first talked to Robert Sr., and told him that she was upset that McNeary told her to keep her mouth shut about their relationship. David Jackson first interview was with police, and he didn't say anything about McNeary saying Campbell didn't do it. Lacey Ortez also spoke to police but told them that McNeary never confessed. All those stories changed when they got to the witness stand. Richard Judkins isn't the "linchpin" of this case. The defense claims he was reliable, and that since he heard shots that proves that shots were fired at the party. The man he ID'd as McNeary at the party was 6'7" 300lbs so it wasn't McNeary. He claimed someone was shot in the mustang- that's a lie. He claimed Kenny was shot in the abdomen- that's a lie. He claims the cougar had been shot- the was a lie. Richard Judkins wasn't reliable. The defense says it was stupid to park the mustang and run. The only way to prove who was driving was to catch them driving the mustang. By parking the mustang it breaks the link that would have caused McNeary a 3rd strike. Kenny Riggins corroborates that McNeary hid the keys up in the hills . If McNeary still had the keys at 4:15am and he was waiting on the street corner, why didn't he drive away or walk back to Janielle's? Nothing proves that McNeary was on Calle Almaden that morning. The defense claims that McNeary called Janielle from a pay phone. There are no pay phones up in the rural areas of Almaden Valley, and Janielle then waited for Campbell to call. If McNeary used a pay phone by the crime scene, then why didn't he walk to Janielle's instead of waiting to "meet" Campbell? This is speculation, reasonable doubt doens't exist in imagination. The defense went to the lowest of lows, they blamed the victim. They suggest that Jeff was at fault. They say Jeff abandoned lessons and procedures that would have protected him. That's wrong, it ignores reality. We don't know that Jeff didn't radio in a call. Ofc. Biskup didn't encounter a dead zone when he reached Jeff and called for an ambulance. The problem with that is that Jeff's radio call would have came in from somewhere else. Training Ofc. Gil-Blanco testified that there are dead zones in the Almaden Valley. Even today radio calls get covered. It could of happened back then, radio calls are only taken one at a time, two officers can't call in at the same time. Every job has a busy season, and for the police it is busy on the weekends, especially on Saturday nights/ Sunday mornings. This was a vehicle stop. These aren't fixed events, unexpected situations come up all the time. Officers are taught to be out of the car within 3-5 seconds. Jeff passed his spotlight training, and knew it was used for an advantage. The spotlight was point way to the left. Ofc. Biskup observed Jeff on the ground, and didn't note how the light was pointing because he was trying to help his team member. The defense said Jeff must have been a muck out there because his lights weren't pointing. The reality is that Jeff didn't have time to set his spotlights. This crime happened quickly. The defense gave scenarios yesterday but they don't hold up.
Scenario #2: Fontana found the mustang and tried to investigate it. The truth is that he wouldn't leave the mustang because it would have to stay in police custody for investigative purposes.
Scenario #3: Saw Hyundai & sees McNeary running- They would have all been at end of the street around same time, that means the defense story Campbell was talking to McNeary would be logical.
Scenario #4: He wanted to write reports- Ofc. Recinos said they picked places to write reports so they could do it together for safety reason, you never do it along, it makes you vulnerable.
Scenario #5: He was lost and came upon Campbell and McNeary, If this happened why would he put his light in the number 2 position, it doesn't make sense.
Scenario #1: Saw the Hyundai on an adjacent street and started to follow. The defense dismissed this one because there was no communication. This is the most likely to have happened. Evidence shows that this was very quick and sudden.
Despite their best efforts, even the best officers can face unpredictable situations. Campbell has shown he can be unpredictable. The incidents with Ofc. Alvarez and the officers at the Good Guy's shows one thing: that Campbell didn't have a gun in those incidents. The defense showed McNearys actions, trying to show he was guilty.
  • Runs to Gilroy, sleeps in creek
  • tosses keys away to mustang
  • distances himself from mustang
  • acts suspiciously with Ofc. Barg
  • Calls Janielle on a 3 way
  • changes clothes after getting home
  • doesn't sleep
This shows that McNeary was scared he ran someone over at the party, and the cops knew. McNeary didn't flee until 6 weeks after the shooting. At the police station, McNeary realizes that the interview was for more than a hit and run. That's why he tells Janielle to tell the f**king truth. 8 years ago Janielle said she told Campbell to come to her apartment. Campbell in 2009 tells us that she told him to go to the mustang. When Janielle was talking to McNeary at the police station she said "Shawn says he was coming to the house". That proves he didn't know McNeary was still out there unaccounted for. There is a memorial in Washington DC with a quote that says "In Valor there is Hope". That is true today,I have hope you will come back with the correct verdict. DeShawn Campbell is guilty!!


That's it. It's now in the JURORS HANDS. I will try to put up when the verdict comes back.

  4. What the heck is going on with the jury? This is day 4, this should have been straight forward GUILTY. Even the defense said " he does well in a structured environment. I am praying daily and hoping that the jury does right, because this animal back on the streets will be blood on each of their hands

  5. A very well done running commentary. I don't agree with all of the rhetoric, but I heartily applaud your diligence, honor and respect for your brother in bringing your opinion to the public in an appropriate way. More information is always better than less. Good luck to you and your family.

  6. why is this taking so long. He is guilty, why can't they see that. And if they can't figure it out, both men should go away. Because I am sure they both deserve to anyway. Anyone who is not legally able to carry a gun, and only does so to get revenge because of a girl, drugs or some other stupid reason, needs to be locked up to keep the regular civilian world and offericers safe. We can't afford to lose anymore good men and women who are out there to protect us from evin like both of those men are! I hope DeShawn rots in prison for the rest of his life. It makes me sad that when he does get there, he is a hero for killing a cop. Sick, pure sick!

  7. We are all on pins and needles, but I read somewhere that it's expected that for every week (five days) of testimony, expect a day of deliberations. We all want every i dotted and t crossed so this verdict sticks in the appellate court.

    Greg, what were the totality of the charges? Were there lesser charges offered to the jury? (Not that I believe anyone in their right minds buys anything but Murder 1. At the minimum, it was Campbell's gun. We all know it was really Campbell ...)

    The best to your family, please hang in there, there are friends praying that justice is done for Jeff.

  8. From my experience (32 years) in criminal courts, the jury will come back Friday as they will not want to return after a long weekend. If they don't, there is a chance of a hung jury.
    There is no way a jury could adquit.

  9. Nope, no lesser charges given to the jury.

    2nd degree murder, life w/o parole
    felon in poss. of a gun- don't know sentence for that ( defense conceded it already)
