Day 4: Neighbors

There might be some details in the testimony from today that could be offensive.....

Beverley Dunn- Resident of Calle Almaden
Her house is on the north side of the street. She went to a Halloween party at the Wrights house at the end of the Cul-de-sac. She had a few "adult" beverages at the party. At around 4:00-4:15am she heard a noise, a possible gunshot. She is in her bedroom, which faces the street on the second floor of the house. She then heard the sound of feet running down the street. Before she heard the noise she did not hear yelling or an argument. Cross examination-- She said her husband had changed the clocks to account for daylight savings. Her husband was in the bathroom when she heard the gunshot. She said it sounded like someone was running down the street and then it sounded like they went on the grass near her house. She never actually saw anyone. She pointed out that the footsteps didn't ever stop but slowed down.
Michelle Jorden- Coroner
Qualified as a forensic pathologist. She examined the records, but did not do the actual autopsy. She said the records are trustworthy. The autopsy occurred Oct. 28, 2001 at 10am. She said there were signs of stippling(which is basically unburnt gun powder) that makes it look like freckles. She said stippling is when the gun is within 10mm-2 ft from the victim. She also pointed out that Jeff had a devastating injury to his brain that caused death within seconds. The entry point was at his right eyebrow. It cause massive brain damage. There was not other signs of injury to Jeff. There was signs of resuscitation from the EKG pads. Once the injury occurred there would be no level of consciousness or movement from Jeff. There was no defense cross examination.
Tereza Wright- Resident of Calle Almaden
She owns the house at the end of the Cul-de-sac. She hosted a Halloween party that night, and drank a few glasses of wine. Her husband woke her up in the middle of the night to say he heard a loud sound. Her bedroom window faces the cul-de-sac, so she looked out the window. She saw lights reflecting, so she walked out to the balcony and say Ofc. Fontana laying on the ground. She then called 911, which she said was about 10 mins from the time she woke up from the time when she called for help. She started to go outside but her husband thought the area wasn't safe so he stopped her. No defense cross examination.
George Wright- Resident
Husband to Tereza. Throughout the day and night drank 12 beers. Says the party ended around midnight and ended up falling asleep on the couch in the back of the house. He competitively shoots guns so knew that it was a gunshot that woke him up. He thought it was a .45 or .357. He went upstairs to see if his wife heard the sound, he looked out a window and saw the police cruiser with its door open. He moved to the den and saw the suspects car, that had all doors closed. He then moved to another window and was able to Jeff laying on the ground with blood coming from his head and told his wife to call 911. He said it felt like 15mins till someone arrived, but it wasn't. The next day during his interview with police he said he thought he has seen that car before. He told them he was driving down Blossom Hill @ Almaden the month before. He actually wrote down the license plate of the car he saw that night. He placed Campbell in that car. He called "311" that night and made a report that hasn't come out yet(i don't know why) Defense: he didn't make the connection with the car until later that day. He went home and looked at the license plate, and it matched up to the vehicle he saw the month before. The defense said the car he reported that month before was brown, and not light brown like the one he saw the night of the shooting. The defense also pointed out that he never ID'd Campbell before with the police.
Sheena Brooke- Resident of Calle Almaden
She heard a noise at 4:10am. She was awake at the time and thought it was a gunshot. She had changed the clock the night before because she had to have the correct time so she could go church the next day. Her windows were open that night and her bedroom fronted Calle Almaden. She heard ONE set of footprints running towards Porto Alegra. She didn't hear any yelling or arguments before the shooting. Defense: She didn't know what side of the street the footsteps were on but originally said it was the south side of the street. She said the footsteps were maybe 2-3 mins after the shot. (it seems really long, but that is what she said)
Kimberly Brady- Resident of Calle Almaden
She heard a shot at 4:27am. She looked around but didn't see anything. She finally stepped outside when the fire engine come down the street. She said that no other police cars were there yet, but saw the police cruiser behind a small light colored sedan. She said the fire engine arrived withing 3-5min of the gun shot. Defense: Was George Wright drinking margaritas? no he wasn't .she didn't see any suspects running from the scene. She was pretty sure the suspects door was open.
Annette Bailey- Resident of Calle Almaden
Awoken by a loud noise at what her clock said was 4:37am. She sets her clocks 10 mins fast. She went outside about 7-10 mins later, and saw a lot of police and fire. She didn't hear any sounds before the shot. Defense: She didn't hear anything after the shot either.
Maureen Resz- Resident of Calle Almaden
She heard a gunshot at around 4:27am. She didn't hear any arguments or yelling before the gunshot. After the shot she heard some noise in her backyard bushes. Her bedroom is in the back of her house(i think the only one so far). She asked her husband to go out back to check out the noise, but he didn't go. She saw the fire engine arrive about 10 mins later. Defense: She said it was about 4:30 when the noise came from the back yard. 10-15 mins until the fire engine came. Then later there were police officers in her back yard and then around 6-7am a police dog came into her backyard for about 15 mins.
Officer Recinos- SJPD
He was in the same district as Jeff and worked a call at about 4am with Jeff. They cleared the call at about 4:15am. He was going to a report writing spot that had been pre-designated, it was behind a church on Gallop & Hoffman. Ofc. Recinos invited Jeff to that spot and they started to drive there with Recinos in the lead. He saw Jeff continue on when he turned to go to the report writing spot. While writing reports he heard dispatch call for officer down. He didn't know where Calle Almaden was(which is pointed out as one reason Jeff didn't call in his location either because he didn't know the name of the street...he worked this area too and still didn't know this particular street) , and had to look it up in his map book. He arrived at Calle Almaden at 4:39am, and was the first to arrive. He saw the patrol car behind a suspects vehicle and then saw Jeff laying on the ground. He said Jeff's amber lights were on and the engine was on. He said there was a pool of blood on the ground under Jeff's head. He tried to find a pulse but couldn't find one, and within a min or so, he and a few others moved Jeff behind a fire engine. Defense: no questions. Juror questions: Did the report show time of dispatch? 4:36am. Did you talk to Jeff on why he didn't turn? He texted Jeff with his computer in the patrol car and Jeff said he was going to continue his patrol for awhile(which rookies do to show they are dedicated workers). Do SJPD have cameras in their cars? No they don't

  2. Thank you for doing this. Reading this testimony is bringing back all of the memories from that night. It's difficult to read, and the tears for Jeff come back all too easily. I'm praying for justice to be served, and always keeping Jeff in my prayers.
